Under Virginia law, a person may be charged with DWI/DUI if that person operates a motor vehicle while their abilities are impaired by alcohol and/or drugs. Often this means that the prosecutor relies on a breath or blood test to prove their case. It is presumed that a person was intoxicated if that person is shown to have a blood alcohol level of 0.08% or higher. A prosecutor does not need a breath or blood test to try someone for DWI/DUI, however, in those cases there is no presumption of impairment.
Prince William County DWI Penalties
No matter the specific drunk driving charges that a driver may face, the penalties associated with a conviction in Prince William County, Virginia are severe. For a first DWI conviction, these may include:

Minimum jail sentences may be imposed depending upon the driver’s BAC (blood alcohol concentration). If a driver’s BAC is .15% to .20%, a driver will face a 5 day mandatory minimum sentence. If a driver’s BAC is .21% or greater, he or she will face a 10 day mandatory minimum jail sentence. These mandatory minimum sentences are even greater for second DWI/DUI convictions within a ten year period.
